En el presente artículo, el autor analiza el concepto de leyes prácticas propuesto por Kant en la Crítica de la razón práctica, poniendo énfasis en los antecendentes que este concepto tiene en la escuela del derecho natural moderno y en el giro que este concepto representa, ya que en él se hace patente el paso desde una ética de la obligación hacia una ética de la autonomía. Se analizan además las propiedades esenciales del concepto de leyes prácticas y los problemas (...) filosóficos que surgen a partir de él y se sitúa dicho concepto en el contexto general de la ética kantiana y de la filosofía moral. In this article the author analyzes the concept of "practical law" as developed by Kant in his Critique of Practical Reason. The author notes the roots of this concept in the modern school of natural law and states that this concept represents a shift from an ethic of obligation to an ethic of autonomy. In addition, the author analyzes the essential features of the "practical law" concept; the philosophical problems that arise from it, and the place of this concept in the landscape of Kantian ethics and moral philosophy. En el presente trabajo se aborda la discusión acerca de la influencia de Nietzsche en el pensamiento transhumanista. El artículo sostendrá la tesis que no hay semejanzas estructurales entre ambas líneas de pensamiento. El principal argumento que respalda esta idea radica en que Nietzsche, a diferencia del transhumanismo, que plantea una mejora de la condición humana por medios tecnológicos con fines hedonistas, propone una superación del hombre de carácter moral por medio del superhombre y del pensamiento del eterno retorno.

We elucidate the epistemological futility of using concepts such as unconscious thinking in research. Focusing on Newell & Shanks' (N&S's) use of the lens model as a framework, we clarify issues with regard to unconscious-thought theory (UTT) and self-insight studies. We examine these key points: Brunswikian psychology is absent in UTT; research on self-insight did not emerge to explore the unconscious; the accuracy of judgments does not necessitate the unconscious; and the prescriptive claim of UTT is unfounded.

El siguiente artículo tiene por objetivo mostrar la mutua correspondencia entre experiencia e historicidad en la obra de Hans-Georg Gadamer. La experiencia es entendida como el movimiento fundamental de la existencia histórica, la que articula las diversas esferas de la acción humana. La experiencia hermenéutica pone de manifiesto que el comprender no puede fundarse en un procedimiento metódico, sino en la forma del existir situado en el mundo. El acto hermenéutico es entendido como un continuo proceso de apropiación, que se (...) realiza mediante el lenguaje, y donde se van actualizando nuevos significados que develan el carácter aconteciente y móvil de la interpretación. Por ello, la historicidad de la comprensión será el principio hermenéutico fundamental que excluye la posibilidad de una conciencia histórica absoluta, a favor de una “conciencia de la repercusión histórica” (wirkungsgeschtliches Bewußtseins). The following article aims at showing the mutual correspondence between experience and historicity in the work of Hans-Georg Gadamer. Experience is understood as the fundamental movement of the historical existence, whichvarious spheres ofhuman action. The hermeneutic experience shows thatnot lie in methodical procedure, but in the way of existence in the world. The hermeneuticis understood as a continuing process that is carried out through language and where new meanings are updated, that reveal mobile characteristics of the interpretation. Therefore, the understanding the hermeneutical principle which excludes possibility ofabsolute consciousness, in favor of a historically-effected consciousness (wirkungsgeschtliches Bewußtseins). La tesis central de este artículo sostiene que la doctrina del factum de la razón planteada en la Crítica de la razón práctica es insuficiente para dar cuenta de la normatividad de las leyes prácticas y que debe buscarse, por lo tanto, una evidencia directa de la «presión normativa» que las leyes morales ejercen sobre nosotros. Esta evidencia puede ser encontrada, de acuerdo a la tesis del autor, en la fenomenología de la conciencia que Kant desarrolla en la Doctrina de (...) la Virtud, segunda parte de la Metafísica de las Costumbres. The purpose of this article is to argue that the Kant´s factum of reason doctrine raised in his work the Critique of Practical Reason it is insufficient to explain the normative role of the practical law and, for this reason, it is necessary to search for a direct evidence of the «normative pressure» practices must be sought, therefore, that moral laws have on us. This evidence can be found, according to the thesis on this article, on the phenomenology of consciousness developed by Kant in the Doctrine of Virtue, Part II of the Metaphysics of Morals. (shrink)

People often face preferential decisions under risk. To further our understanding of the cognitive processes underlying these preferential choices, two prominent cognitive models, decision field theory (DFT; Busemeyer & Townsend, 1993) and the proportional difference model (PD; González‐Vallejo, 2002), were rigorously tested against each other. In two consecutive experiments, the participants repeatedly had to choose between monetary gambles. The first experiment provided the reference to estimate the models’ free parameters. From these estimations, new gamble pairs were generated for (...) the second experiment such that the two models made maximally divergent predictions. In the first experiment, both models explained the data equally well. However, in the second generalization experiment, the participants’ choices were much closer to the predictions of DFT. The results indicate that the stochastic process assumed by DFT, in which evidence in favor of or against each option accumulates over time, described people’s choice behavior better than the trade‐offs between proportional differences assumed by PD. El punto de partida del análisis es el discurso en el mercado situado en el prólogo de la obra, en el que Zaratustra proclama por primera vez el advenimiento del superhombre. La reconstrucción de su posición antropológica supone la consideración de algunos pasajes especialmente relevantes en los que el autor se refiera a la muerte de Dios, al (...) último hombre y el superhombre, la voluntad de poder y el eterno retorno; a manera de conclusión, argumento que, sin perjuicio de la presencia de conceptos como “perspectivismo” o “muerte del sujeto”, la obra no tiene un fin deconstructivo, sino que consiste en una reflexión acerca de la plenitud y la decadencia de la condición humana. The COVID-19 pandemic has drastically changed the lives of people all over the world. In particular, an unprecedented educational crisis has occurred due to the circumstances of physical distancing and remote learning. This article focuses specifically on the meaningful learning experiences in the everyday lives of adolescents during the pandemic. 72 meaningful learning experiences were identified from 11 participants who recorded their specific learning experiences for a week by a means of a journal recorded by themselves. A content analysis was (...) undertaken in order to identify the ecology of the different learning experiences. The results show a prevalence of personal and conceptual learning, a presence of both formal and specifically informal, everyday activities among the meaningful learning experiences detected, the importance of peers, teacher and “learning experiences while alone,” and the use of digital technologies as learning resources; they also reveal the assistance of others in the learning process. The main contribution of this study illustrates how students in everyday life during pandemics are involved in a whole range of different activities both at school and at home. (shrink)

Current research has focused on gender as a conditioning factor in students’ study choices, highlighting the existence of gender stereotypes associated with these choice. The general objective of this article is to analyse if there are differences based on sex in the choice of musical instruments in music conservatories. The methodology used is quantitative. We have analysed the data on enrolment in the different instrumental specialities of two public music conservatories in Seville (Spain) at the three levels of music education: (...) Basic, Professional and Higher Music Education. This article contrasts if there are instrumental specialities that are mostly chosen by one or the other sex, and to check if this sexual segregation has been produced by chance or can be explained by other causes. This investigation was carried out for a total of 4120 students from two different conservatories. The main conclusions of the study were the existence of feminized and masculinized instrumental families, and the relationship between the variables “students’ sex” and “instrumental families and musical specialities” was significant with a medium effect size. This research confirms that men and women choose the instruments that have traditionally been associated with their male or female roles respectively. (shrink)

Fibromyalgia is a chronic pain syndrome characterized by dysfunctional processing of nociceptive stimulation. Neuroimaging studies have pointed out that pain-related network functioning seems to be altered in these patients. It is thought that this clinical symptomatology may be maintained or even strengthened because of an enhanced expectancy for painful stimuli or its forthcoming appearance. However, neural electrophysiological correlates associated with such attentional mechanisms have been scarcely explored. In the current study, expectancy processes of upcoming laser stimulation (painful and non-painful) and (...) its further processing were explored by event-related potentials (ERPs). Nineteen fibromyalgia patients and twenty healthy control volunteers took part in the experiment. Behavioral measures (reaction times and subjective pain perception) were also collected. We manipulated the pain/no pain expectancy through an S1–S2 paradigm (cue-target). S1 (image: triangle or square) predicted the S2 appearance (laser stimulation: warmth or pinprick sensation). Laser stimuli were delivered using a CO2 laser device. Temporal and spatial principal component analyses were employed to define and quantify the ERP component reliability. Statistical analyses revealed the existence of an abnormal pattern of pain expectancy in patients with fibromyalgia. Specifically, our results showed attenuated amplitudes at posterior lCNV component in anticipation of painful stimulation that was not found in healthy participants. In contrast, although larger P2 amplitudes to painful compared to innocuous events were shown, patients did not show any amplitude change in this laser-evoked response as a function of pain predictive cues (as occurred in the healthy control group). Additionally, analyses of the subjective perception of pain and reaction time indicated that laser stimuli preceded by pain cues were rated as more painful than those signaling non-pain expectancy and were associated with faster responses. Differences between groups were not found. The present findings suggest the presence of dysfunction in pain expectation mechanisms in fibromyalgia that eventually may make it difficult for patients to correctly interpret signs that prevent pain symptoms. Furthermore, the abnormal pattern in pain expectancy displayed by fibromyalgia patients could result in ineffective pain coping strategies. Understanding the neural correlates of pain processing and its modulatory factors is crucial to identify treatments for chronic pain syndromes. (shrink)

Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

Schools are an essential part of students’ lives and can promote and facilitate their well-being. Although research on well-being among school-aged children and adolescents has distinguished subjective well-being from social well-being, very few studies examined student’s social well-being at school. SWS is understood as students’ valuation of the circumstances and functioning of their school. This framework posits that the context of the schools can shape students’ perception of feeling integrated and making significant contributions to their schools. However, not much is (...) known regarding the joint contribution of individual, family, and school characteristics to students’ SWS. This study analyzed these joint contributions in a nationally representative sample of 6,389 children and adolescents enrolled in 5th–11th grades. Findings show that being female and younger were individual predictors of SWS. Students’ satisfaction with their family and fewer changes of schools were also significant contributors. When students’ perceptions of their schools were incorporated, the individual and family characteristics decreased or lost significance. In the full model, the highest contribution to SWS was explained by the school-level aggregated perception of school climate. These findings call for integrated policies and practices to foster students’ sense of belonging, feeling integrated, and contribution to their schools, with a focus on school-level interventions to improve SWS through positive and engaging school climates that foster students’ sense of agency. Evidence about whether reflective thinking may be induced and whether it affects utilitarian choices is inconclusive. Research suggests that answering items correctly in the Cognitive Reflection Test (CRT) before responding to dilemmas may lead to more utilitarian decisions. However, it is unclear to what extent this effect is driven by the inhibition of intuitive wrong responses (reflection) versus the requirement to engage in deliberative processing. To clarify this issue, participants completed either the CRT or the Berlin Numeracy Test (BNT) – (...) which does not require reflection – before responding to moral dilemmas. To distinguish between the potential effect of participants’ previous reflective traits and that of performing a task that can increase reflectivity, we manipulated whether participants received feedback for incorrect items. Findings revealed that both CRT and BNT scores predicted utilitarian decisions when feedback was not provided. Additionally, feedback enhanced performance for both tasks, although it only increased utilitarian decisions when it was linked to the BNT. Taken together, these results suggest that performance in a numeric task that requires deliberative thinking may predict utilitarian responses to moral dilemmas. The finding that feedback increased utilitarian decisions only in the case of BNT casts doubt upon the reflective-utilitarian link. (shrink)

This paper addresses a variant of the job shop scheduling problem with total tardiness minimization where task durations and due dates are uncertain. This uncertainty is modelled with intervals. Different ranking methods for intervals are considered and embedded into a genetic algorithm. A new robustness measure is proposed to compare the different ranking methods and assess their capacity to predict ‘expected delays’ of jobs. Experimental results show that dealing with uncertainty during the optimization process yields more robust solutions. A sensitivity (...) analysis also shows that the robustness of the solutions given by the solving method increases when the uncertainty grows. (shrink)

This paper examines whether there are moral differences between the mitochondrial replacement techniques that have been recently developed in order to help women afflicted by mitochondrial DNA diseases to have genetically related children absent such conditions: maternal spindle transfer and pronuclear transfer. Firstly, it examines whether there is a moral difference between MST and PNT in terms of the divide between somatic interventions and germline interventions. Secondly, it considers whether PNT and MST are morally distinct under a therapy/creation optic. Finally, (...) it investigates whether there is a moral difference between MST and PNT from a human embryo destruction point of view. I conclude, contra recent arguments, that regarding the first two points there is no moral differences between PNT and MST; and that regarding the third one MST is morally preferable to PNT, but only if we hold a gradualist account of the moral value of human embryos where zygotes have slight moral value. Several objections against the morality of researching or employing mitochondrial replacement techniques have been advanced recently. In this paper, I examine three of these objections and show that they are found wanting. First I examine whether mitochondrial replacement techniques, research and clinical practice, should not be carried out because of possible harms to egg donors. Next I assess whether mitochondrial replacement techniques should be banned because they could affect the study of genealogical ancestry. Finally, I examine the claim that mitochondrial (...) replacement techniques are not transferring mitochondrial DNA but nuclear DNA, and that this should be prohibited on ethical grounds. (shrink)

Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

In this work I present a detailed critique of the dignity-related arguments that have been advanced against the creation of human–nonhuman chimeras that could possess human-like mental capacities. My main claim is that the arguments so far advanced are incapable of grounding a principled objection against the creation of such creatures. I conclude that these arguments have one, or more, of the following problems: they confuse the ethical assessment of the creation of chimeras with the ethical assessment of how such (...) creatures would be treated in specific contexts, they misrepresent how a being could be treated solely as means towards others’ ends, they fall short of demonstrating how humanity’s dignity would be violated by the creation of such entities, and they fail to properly characterise the moral responsibilities that moral agents have towards other moral agents and sentient beings. The objective of this work is to establish a relationship between the cutting time in rocks, determining a speed and the point load strength index test, Is, to characterize the rock in terms of resistance and avoid sending samples to laboratories. As a first stage, on andesite samples, 5 x 5 x 10 cm test tubes were made. After the elaboration they were subjected to cutting, using an electric floor cutter and the time was evaluated. This cut was made in (...) a transversal way and two parts were obtained, one of them with dimensions 5 x 5 x 5 cm, approximately. In a third stage, the point load strength test was carried out in a press built for this purpose. Finally, the cutting speeds were correlated with the point load test values and only when rock samples do not pigeonhole on the proposed relationship, send them to the laboratory. According to logical non-necessitarianism, every inference may fail in some situation. In his defense of logical monism, Graham Priest has put forward an argument against non-necessitarianism based on the meaning of connectives. According to him, as long as the meanings of connectives are fixed, some inferences have to hold in all situations. Hence, in order to accept the non-necessitarianist thesis one would have to dispose arbitrarily of those meanings. I want to show here that non-necessitarianism can stand, without disposing arbitrarily (...) of the meanings of connectives, based on a minimalist view on the meanings of connectives. (shrink)

Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. RESUMEN La medicina tradicional herbolaria desde su evolución hasta la contemporaneidad ha sido objeto de uso para la medicina convencional. Por eso el objetivo del trabajo es describir el comportamiento de la medicina tradicional herbolaria en los sistemas de salud convencionales. Se realizó la búsqueda y análisis documental de numerosas fuentes sobre la temática pertenecientes a las bases de datos SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo. Se concluye que la actualidad social registra manifestaciones alentadoras en el (...) campo de la aceptación de la herbolaria como medicina complementaria por el equipo de salud y un renovado interés en el ámbito mundial por estudiar los efectos que tienen las plantas sobre la salud. ABSTRACT The traditional herbalist medicine from its evolution to the contemporaneity has been an object use for the conventional medicine. That's why the objective of the work is to describe the behavior of the traditional herbalist medicine in the conventional health systems. A search and documentary analysis of numerous sources on the subject-matter belonging to the databases SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo was carried out. It is concluded that the social actuality registers encouraging declarations in the field of the acceptance of the herbalist as complementary medicine for the team of health and a renewed interest in the world ambience to study the effects that have the plants on the health. Despite the diverse legal approaches towards surrogacy in Europe, there are common socio-legal arguments attempting to legitimise it amongst the European Union member states. Regardless of the prevailing regulation in each country, surrogacy in general is confronted with common criticisms and faces similar obstacles. For instance, the operative definition of altruism is put under question in countries where altruistic surrogacy is permitted. Surrogacy is also considered an attack on a woman’s dignity and a risk to children’s welfare. Behind such claims, (...) however, rests the common yet unsubstantiated belief in a natural maternal instinct. Furthermore, a clear misunderstanding about the bonding theory still persists. Common debates around surrogacy in Europe show us that, beyond the national margin of appreciation, surrogacy challenges basic definitions of motherhood, filiation and family. These challenges are deeply permeated by gender stereotypes which partially explain the national similarities among the legal diversities. (shrink)

La ideación artística y arquitectónica está en gran medida configurada a partir de un concepto o metáfora que rige los diseños como síntesis de nuestro pensamiento y que, posteriormente, se ve confrontada con el lugar, creando con ello una cierta tensión entre paisaje e intervención proyectual. Este artículo explora el concepto de «corte» de Sverre Fehn, tomado como elemento simbólico de resistencia ligado al tiempo, al lugar y a la memoria, como idea generatriz, basada en analogías conceptuales que el artista (...) aplicaba en sus proyectos. Así, un simple gesto, una grieta, una hendidura o incluso un vacío en el terreno, es tomado como memoria pues, de algún modo, configura la idea del lugar que recorremos con la mirada y remite al testimonio de otro tiempo mientras lo experimentamos en diálogo permanente con el paisaje en el que se inscribe. Se crea así una relación intensa entre luz, espacio, materia y memoria con el horizonte paisajístico, como límite de la obra. Este artículo realiza un recorrido por diferentes obras artísticas, arquitectónicas e incluso patrimoniales. Su denominador común es el concepto «corte», un elemento de permanencia que facilita una lectura integradora desde el proyecto, en un intento por cruzar e, incluso, vincular el lenguaje empleado entre las disciplinas para diluir las fronteras, traspasar los límites, recobrar la memoria y establecer, como diría Rosalind Krauss, un nuevo «territorio expandido». Autonomous sensory meridian response (ASMR) and affective touch (AT) are two phenomena that have been independently investigated from separate lines of research. In this article, I provide a unified theoretical framework for understanding and studying them as complementary processes. I highlight their shared biological basis and positive effects on emotional and psychophysiological regulation. Drawing from evolutionary and developmental theories, I propose that ASMR results from the development of biological mechanisms associated with early affiliative behaviour and self‐regulation, similar to AT. I (...) also propose a multimodal interoceptive mechanism underlying both phenomena, suggesting that different sensory systems could specifically respond to affective stimulation (caresses, whispers and affective faces), where the integration of those inputs occurs in the brain's interoceptive hubs, allowing physiological regulation. The implications of this proposal are discussed with a view to future research that jointly examines ASMR and AT, and their potential impact on improving emotional well‐being and mental health.
